A criminal complaint of second-degree murder has been filed against a Big River man after he allegedly struck and killed a bicyclist with his car Tuesday night in Parker. Charges were filed Wednesday against Angel Covarrubias Jr., 22, of Big River, Calif. Judge Charlene Weis of the Parker Justice Court set his bond at $200,000.
Parker Police Chief Rod Mendoza said the accident occurred at approximately 6:08 p.m. on California Avenue near the intersection of Kofa Avenue. Mendoza said Covarrubias was coming east from California in a four-door sedan when he attempted to pass two other vehicles and crossed a double-yellow centerline on the roadway...
commentary on the sentence: Manslaughter is a class 2 felony; if sentenced under 13-702 (so-called "non-dangerous" felony), then the presumptive is 5 years, not 4 as stated in the new article. However, if sentenced under 13-704, because it is "dangerous", the same class 2 felony presumptive is 10.5 years. Conclusion is the guilty party seems to have gotten off light.
